IRCC Introduces Open Work Permit Options for Select PNP Candidates

Immigration, Refugees and Citizenship Canada (IRCC) has introduced a new temporary policy that allows certain Provincial Nominee Program (PNP) candidates to apply for an open work permit (OWP). This initiative is designed to facilitate the transition of eligible temporary residents into permanent residency pathways, addressing labor market needs in Canada.



Key Details of the New Policy

The policy came into effect on August 11, 2024, and will remain in place until December 31, 2024. However, IRCC reserves the right to revoke the policy at any time without prior notice. Eligible individuals can apply for an OWP if they meet specific criteria, including having a job offer, a valid work permit, or a work permit that expired on or after May 7, 2024. Additionally, applicants must provide a support letter from the relevant provincial or territorial authority, confirming their placement in an Expression of Interest pool or another application inventory process.


Eligibility Scenarios

The policy outlines three scenarios under which candidates may qualify for the OWP:

Current Valid Work Permit Holders: Candidates must have submitted an application for a new work permit under section 200 of the Immigration and Refugee Protection Regulations, along with a support letter from the provincial authority and a letter of employment from their current employer.

Expired Work Permit Holders: Candidates whose work permits expired on or after May 7, 2024, must have applied for a new work permit and either an extension of their temporary resident status or restoration of that status. They also need the same supporting documents as in Scenario 1.

Pending Work Permit Extension: Foreign nationals who were authorized to work as of May 7, 2024, and have a pending or approved extension application must meet similar requirements, including submitting applications for a new work permit and providing the necessary support letters.


Objectives of the Policy

IRCC's primary goal with this policy is to adjust the balance of temporary residents to permanent residents in Canada. By allowing eligible temporary residents to transition through the PNPs, the government aims to retain skilled workers who have already demonstrated their economic potential and built community ties. This approach is expected to enhance the labor market by providing a clearer pathway to permanent residency for those who meet critical needs in Canada.

This policy represents a significant step in Canada's immigration strategy, focusing on retaining talent and addressing labor shortages while facilitating the integration of newcomers into Canadian society.
